1. Our Contract

 

These Terms and Conditions govern the supply of goods sold by Best Specs 4 U .com Ltd (referred to as "we" and "us") of Temperance House, Radway CV35 0UQ.

 

These Terms and Conditions in combination with the order form constitute the complete agreement between us and the customer. Our acceptance of your order by delivery of the goods constitutes a legally binding contract between us on these terms and conditions. This contract is subject to and governed by UK National Law.

 

2. Conditions of Sale

 

Customers must be over 16 years of age. If purchasing a prescriptive pair of spectacles the customer must have been issued with a prescription within the last 2 years. If requested, a copy of this prescription must be provided to us.

 

3. Price & Payment

 

3.1 The price payable for the goods you order is as set out on our website at the time you place your order plus any charges for carriage and insurance as set out in the order form.

 

3.2 We must receive payment for the whole of the price of the goods you order, and any applicable charges for carriage and insurance, before your order can be accepted.

 

4. Delivery & Title

 

Goods will be delivered in accordance with your order. A valid signature will be required on delivery. Immediately after signing for delivery, title of the goods will pass to the customer. In the unlikely event that you have not received the goods within 7 days of the date of delivery you must notify us immediately.

 

5. Availability

 

While we endeavour to hold sufficient stock to meet all orders, on the rare occasion where we have insufficient stock to supply the goods ordered and paid for by you, we will raise a full refund back to the original credit/debit card.

 

6. Cancellation & Returns

 

6.1 You have the right to cancel an order up to 10 days after you take delivery of the goods. Such notice may be given by mailing or email to the address set out on the contact us page of this site. If you are cancelling because of any problem with the goods, please notify us of the problem at the time of cancellation.

 

6.2 We will refund the full cost of the frame on receipt of the returned goods in satisfactory condition.

 

6.3 We will not refund any postage and packing costs incurred with the order.

 

6.4 We will not refund the cost of manufacturing and fitting bespoke lenses to your specified requirement.

 

6.5 You must return the goods to us at your cost unless the goods are being returned because they are faulty or incorrect goods, in which case we will meet the cost of return but we ask that you allow us to nominate the carrier.

 

6.6 The cost of carriage and insurance is non-refundable.

 

7. Liability

 

7.1 If you have notified us of a problem with the goods, we will replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question.

 

We will not be liable to you for any administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer.

 

7.2 We shall not be liable for any errors made by you when entering prescription details online.

 

7.3 Best Specs 4 U .com Ltd is subject to United Kingdom Law. We make no legal provision for other countries and customers outside the UK take full and sole responsibility for compliance with the law in their own country.

 

7.4 We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes.)

 

8. General

 

If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with United Kingdom law.

 

9. Accessories

 

All frames come with one appropriate case and microfibre lens cloth. Case images are examples only and may not represent the exact case supplied.

 

10. Design, Images and Reproduction

 

Whilst all care is taken during the photography and editing of the frame images the actual colour may vary slightly from that shown due to differences in monitor/LCD characteristics.

 

Images, code, layout and style are all copyright. Reproduction in whole, or in part, is strictly prohibited without written permission.
